7. Winners
7.1. The decision of the Promoter is final and no correspondence or discussion will be entered into.
7.2. The Winner’s full name will be announced during the live draw. If you wish for your name to be censored during the live draw please contact [email protected] with reasonable time left before the prize draw takes place.
7.3. The Promoter will contact the winner personally as soon as practicable after the Draw Date using the telephone number or email address provided with the competition entry. If the winner cannot be contacted, is not available, or has not claimed the Prize, within 21 days of the Draw Date the Promoter reserves the right to offer the Prize to another Entrant (“The Alternate Winner“) selected at random in the same method as before from the remaining correct entries received before the Closing Date. The Alternate Winner shall have 21 days from notification of their status by the Promoters to communicate their acceptance of the Prize. This process shall continue until a winner accepts the Prize.
7.4. The Promoter must either publish or make available information that indicates that a valid award took place. To comply with this obligation the Promoter will publish the full name and county/town of residence of major prize winners on the Website.
7.5. If you object to any or all of your surname, county/town of residence and winning entry being published or made available, please contact the Promoter at [email protected] prior to the Closing Date. In such circumstances, the Promoter must still provide the information to the Advertising Standards Authority on request.
8. Claiming the prize
8.1. You must claim the Prize personally. The Prize may not be claimed by a third party on your behalf. Details of how the Prize will be delivered to you (or made available for collection) are published on the Website, or available on request.
8.2. If your personal details, including contact information, changes at any time you should notify the Promoter as soon as reasonably possible. Notifications should be sent to the Promoter via email to [email protected]. Notifications must include details of the competition you have entered, your old details and your new details. If your details change within 10 days of the Closing Date, the Promoter will use your old details if it needs to try to contact you.
8.3. Any Cash Prize will be transferred directly to the winners nominated bank account. The winner must provide evidence that it is the sole or joint beneficiary of the bank account. Failure to do so within 14 days will result in disqualification from the competition and the winner forfeiting the prize. In such circumstances, the Promoter reserves the right to offer the prize to the next eligible Entrant selected from the correct entries that were received before the Closing Date.
8.4. The Promoter does not accept any responsibility and is not liable to pay any compensation if you are unable to or do not take up the prize.
8.5. If the Prize is a vehicle and the winner has completed all eligibility checks, the prize will be transferred to the winner by the Promoter using the V5 for each vehicle. This must be completed before the vehicle is handed over.
9. Limitation of liability
Insofar as is permitted by law, the Promoter, its agents or distributors will not in any circumstances be responsible or liable to compensate the winner or accept any liability for any loss, damage, personal injury or death occurring as a result of taking up the prize except where it is caused by the negligence of the Promoter, its agents or distributors or that of their employees. Your statutory rights are not affected.
10. Data protection and publicity
10.1. By entering the competition, you agree that any personal information provided by you with the competition entry may be held and used only by the Promoter or its agents and suppliers to administer the competition or as otherwise set out in the Promoter’s Privacy Policy, a copy of which is available on the Website.
10.2. If you are the winner of the competition, you agree that the Promoter may use your name, image and town or county of residence to announce the winner of this competition. You further agree to participate in any reasonable publicity required by the Promoter.
10.3. If you do not wish to participate in any publicity, you must notify the Promoter prior to the Closing Date. This will not affect your chances of winning the Prize. If you do not agree to participate in any publicity about the competition we may still provide your details to the Advertising Standards Authority. This is a legal requirement that we must comply with to prove that the competition has been properly administered and the Prize awarded.
10.4. If you are the winner of the competition, you may be required to provide further personal information and proof of your identity in order to confirm your eligibility to claim the Prize and transfer ownership of the Prize to you. You consent to the use of your information in this way. You are entitled to request further details about how your personal information is being used. You may also withdraw your consent to your personal information being used in such way but by doing so you may prevent the Prize being transferred to you. In such circumstances, you will be deemed to have withdrawn from the competition and forfeit the Prize. You will not be entitled to any refund of your entry fee. The Promoter reserves the right to offer the Prize to the next eligible Entrant selected from the correct entries that were received before the Closing Date.
10.5. Please note that under data protection laws you are entitled to request that the Promoter does not contact you and removes your details from its database. If you make such a request you will be withdrawing from the competition as it will not be possible to contact you in the event that you are the winner. You will not be entitled to any refund of any entry fee if you withdraw from the competition. If you do not wish any of your personal details to be used by the Promoter for promotional purposes, please email the Promoter at [email protected] prior to the Closing Date.
11. General
11.1. The Promoter reserves the right to amend these terms and conditions from time to time. The latest version of these terms and conditions will be available on the Website.
11.2. If there is any reason to believe that there has been a breach of these terms and conditions, the Promoter may, at its sole discretion, reserve the right to exclude you from participating in the competition and any future competitions.
11.3. The Promoter reserves the right to hold void, suspend, cancel, or amend the prize competition where it becomes necessary to do so for circumstances out of its control. In such circumstances, the Promoter will refund any entry fees you have paid.
11.4. There is no minimum number of entries and the Promoter will not hold void, suspend, cancel, extend the Closing Date or amend the prize competition due to a lack of entries. The draw will take place and the Prize will be awarded regardless of the number of entries received.
11.5. The competitions on the Website are in no way sponsored, endorsed, administered by or associated with Facebook. By entering the competitions, Entrants agree that Facebook has no liability and is not responsible for the administration or promotion of the competitions.
11.6. These terms and conditions shall be governed by English law, and the parties submit to the exclusive jurisdiction of the courts of England and Wales.
11.7. You should print a copy of these terms and conditions and keep them for your records.
[12]. Complaints and Dispute Resolution
[12.1] If you have a complaint about any aspect of our competitions or service, please contact us in the first instance using the channels set out in our Complaints Policy, available at dartgearcompetitions.co.uk/i/complaints. We will aim to respond within 15 working days and to resolve all complaints within 8 weeks.
[12.2] If we are unable to resolve your complaint internally, or if 8 weeks have passed since you first raised it, you may be entitled to refer the matter to an independent Alternative Dispute Resolution (ADR) provider. Details of our nominated ADR provider will be published in our Complaints Policy once finalised. In the meantime, please contact us for details of an appropriate certified provider. Use of ADR is voluntary and does not affect your statutory rights.
[12.3] These Terms and Conditions are governed by the laws of England and Wales. Subject to clause [12.2] above, the courts of England and Wales shall have non-exclusive jurisdiction over any dispute arising under or in connection with them.
13. Legends of the Oche (player ranks)
13.1 Legends of the Oche is a free feature for registered account holders aged 18 or over. You earn experience points ("XP"), and your total XP places you in one of ten ranks. You will see your current rank, your XP, and the name of the next rank with the XP needed to reach it.
13.2 You earn XP as follows:
- 10 XP for every £1 paid by card on completed orders. Orders paid with wallet credit do not earn XP, and XP from an order that is cancelled or refunded is removed.
- A daily check-in, once per UK calendar day: over seven days in a row the check-ins earn 5, 5, 10, 5, 15, 5 and 30 XP (the "Oche Streak"). After day seven a new streak begins. Missing a day starts the streak again from day one.
- 5 XP for taking part in a completed head-to-head, and 5 XP more for winning it.
- 100 XP for winning a daily challenge (the fastest correct answer).
- 25 XP, once, for completing your profile (first name, last name, email address and phone number).
13.3 Your rank is decided by your total XP alone. Every rank can be reached without spending any money. Facebook activity does not earn XP at present. We may add, change or remove ways of earning XP, and will update this section when we do.
13.4 XP and ranks have no cash value. They cannot be exchanged, transferred, sold or withdrawn, and they do not change your chances of winning any competition.
13.5 From time to time we may run free giveaways for holders of particular ranks, for example during a live draw. Each one will be free to enter, its eligibility and prize will be announced at the time, and the winner will be picked at random from the eligible players. Our staff are not eligible.
13.6 We may correct XP that was awarded in error, and may remove XP, ranks or eligibility for giveaways gained by fraud, by more than one account, by automated means, or in breach of these Terms. You may challenge any such decision through our complaints procedure in clause [12].
13.7 We may change, suspend or end Legends of the Oche at any time. If it ends, XP and ranks will have no value.
14. Facebook fan league
14.1 The Facebook fan league is free. No purchase is needed to take part or to win.
14.2 Points are scored as follows:
- Each comment on a post on the Dart Gear Competitions Facebook page scores 2 points.
- Each reaction (like, love and so on) scores 1 point. Only one reaction per person per post counts.
- Our own replies do not score, and comments on posts by other people or other pages do not score.
- At most 60 different posts score for one person in a week.
- A deleted comment or a removed reaction loses its points.
14.3 Each week runs from Thursday 22:00 to the following Thursday 22:00 (UK time). The leaderboard then starts again from zero.
14.4 You need at least 15 points in a week to win a prize. Each week the top three qualifying people win £10, £5 and £2.50 in Dart Gear Competitions site credit. If people tie on points, they share the prizes for the places they cover equally, rounded down to the penny. Prizes are paid as site credit on your Dart Gear Competitions account and cannot be exchanged for cash.
14.5 Winners are named on our website by first name and the initial of their surname. To claim, message our Facebook page within 7 days of the week ending with the email address of your Dart Gear Competitions account. A prize not claimed within 7 days is not paid.
14.6 You must be 18 or over and live in the UK to win. Our staff and their immediate families cannot win.
14.7 Spam, copied or meaningless comments, fake accounts or anything else that games the league do not count, and we may remove anyone who does this from the league. Our decision on points and prizes is final, subject to our complaints procedure in clause [12].
14.8 We may change the points, the prizes or these rules, or end the league. Any change shows on the leaderboard on our website, and a change during a week applies from when it is made.
14.9 This league is in no way sponsored, endorsed or run by Facebook (Meta), or connected with it. By taking part you release Facebook from any claim about the league. Questions about the league come to us, not to Facebook.
15. Players' chat
15.1 Anyone can read the players' chat. To post you must be signed in to your Dart Gear Competitions account and be 18 or over.
15.2 Be decent: no abuse, bullying, hate, swearing, spam, adverts or links, and do not post anyone's personal details, including your own. Swear words are hidden automatically and links are not allowed.
15.3 Do not pretend to be us. Names that look official are not allowed. Messages from our team are marked HOST.
15.4 We may delete any message, mute anyone for a time, or ban anyone from the chat, without notice. Our decision is final, subject to our complaints procedure in clause [12].
15.5 Nothing said in the chat changes these Terms or any competition, and nothing posted in the chat counts as an entry, an answer or a claim for a prize.
15.6 Messages are kept for 30 days, then deleted. See our Privacy Policy. We may change these rules, switch the chat off or close it at any time.
16. Head-to-heads
16.1 A head-to-head is a free game between players who are signed in to our website at the same time. Taking part is free, and no purchase is needed to take part or to win.
16.2 We choose who is invited, either ourselves or automatically when enough players are on the website. An invitation must be accepted within the time shown. You can decline any invitation, or choose not to be asked again.
16.3 Each game's rules are shown before it starts. Results are decided by our system as the game is played, never by what a device reports. If a game cannot be finished, for example because a player leaves or not enough players join in time, it is called off and nobody wins.
16.4 The winner receives one discount code, as shown with the invitation (for example, a percentage off your next order). Each code can be used once, is subject to its own conditions such as an expiry date or minimum spend, cannot be exchanged for cash and cannot be transferred.
16.5 Our staff may play but cannot win a code. You may only play using your own account. We may cancel a result, and any code won, if it was gained by cheating, by more than one account or by automated means.
16.6 We may change, pause or end head-to-heads at any time.
17. Daily challenges
17.1 A daily challenge is a question open for the times shown on our website. Taking part is free. To take part you need a Dart Gear Competitions account that has placed at least one order of £1 or more.
17.2 Each account has one go at each challenge. The clock starts when you press Start and is kept by our system. The fastest correct answer wins. If two correct answers take exactly the same time, the one answered first wins.
17.3 The prize is shown with the challenge. We add it to the winner's account by hand, usually within 24 hours of the challenge closing and at the latest within 5 working days. Prizes cannot be exchanged for cash.
17.4 Our staff may play but cannot win. You may only play using your own account. We may disqualify an answer, and withhold or take back a prize, if it was gained by cheating, by more than one account or by automated means.
17.5 The winner's first name and the initial of their surname may be shown on our website. We may change, pause or end daily challenges at any time.
18. Bonus Bullseye
18.1 The Bonus Bullseye is a free extra prize that we may run on our website. There is no charge for it and our ticket prices are not raised to pay for it. You cannot enter it or buy a chance of getting one.
18.2 While it is running, our system now and then picks an order at random to get a Bonus Bullseye. We set roughly how many orders there are between Bonus Bullseyes, and our system picks a random order within each run of that many orders. Only completed orders placed on our website from a registered account count. Orders placed by our staff, orders that are cancelled or refunded, and orders below any minimum value we set do not count. We may set a limit on how many Bonus Bullseyes are given in one UK calendar day. Once that limit is reached, no more are given that day.
18.3 If your order is picked, a dartboard with wings appears on the confirmation page for that order once your instant-win reveal has finished. You must be signed in to the account that placed the order to see it. The dartboard flies around the screen for a few seconds, and the prize is shown while it flies. To win, you must tap or click it, or press it using your keyboard, before it flies away. If it flies away, the Bonus Bullseye is lost and nothing is owed.
18.4 Each order can get no more than one Bonus Bullseye, and it can only be won once. A dartboard marked "TEST" is part of our own testing. It is not a prize.
18.5 We add the prize by hand to the wallet shown on screen, on the account that placed the order, within 24 hours of it being won. The account that placed the order gets the prize, whoever pressed the dartboard. Once it is in your wallet, the usual rules for that wallet apply. The prize cannot be exchanged or transferred.
18.6 We may refuse or take back a Bonus Bullseye prize gained by cheating, by automated means, by interfering with our website, or by more than one account. We may also correct a prize given because of a technical fault. You may challenge any such decision through our complaints procedure in clause [12].
18.7 We may change the prize, how often a Bonus Bullseye appears and the daily limit, and we may pause or end the Bonus Bullseye, at any time. A Bonus Bullseye already won before a change will still be paid.
